چکیده

کاستی­های موجود در قوانین مربوط به تملک و تصرف اراضی و املاک متعلق به شهروندان، موجب گردیده است که فرآیند سلب مالکیت توأم با تضییع گسترده‌ی حقوق شهروندان ­باشد. با نقض اصل حاکمیت قانون از سوی شهرداری و خلع ید مالکان، بدون پرداخت حقوق قانونی آن‌ها، مالکان متضرر از اجرای طرح، دعوای مطالبه‌ی بهای اراضی تملک شده را علیه شهرداری اقامه می­نمایند. لیکن در جریان دادرسی موانع متعددی وجود دارد که احقاق حق مالکان را با چالش­های جدی روبرو می­سازد، به طوری که در نهایت مالکان غالباً از دریافت قیمت روز اراضی تملک شده محروم می­شوند و بخش قابل توجهی از زیان وارده به آن‌ها بدون جبران باقی می­ماند. از این رو، در این تحقیق ضمن شناسایی موانع دادرسی و چالش­های وصول محکوم­به از شهرداری، راهکارهایی را برای حمایت از شهروندان و تضمین اصل برابری همگان در پرداخت هزینه ­های عمومی پیشنهاد می­دهیم.

چکیده [English]

The shortcomings in the laws related to the acquisition and possession of land and properties belonging to citizens have caused the process of expropriation to be accompanied by widespread violation of citizens' rights. By violating the principle of the rule of law by the municipality and dispossessing the owners, without paying their legal rights, the owners affected by the implementation of the project will file a claim against the municipality for the price of the acquired lands. But during the proceedings, there are many obstacles that make the rights of the owners face serious challenges, so that in the end, the owners are often deprived of receiving the daily price of the acquired land, and a significant part of the damage caused to them remains uncompensated. Therefore, in this research, while identifying the legal obstacles and the challenges of collecting the fine from the municipality, we propose solutions to support the citizens and guarantee the principle of equality for all in paying public expenses.
