چکیده
این مقاله از طریق بهکارگیری روش رایج «تحلیل مفهومگرا» و با رویکرد «غیر ذاتگرا» در پی شناخت مفهوم حقوق عمومی از دیدگاه هارت و بر اساس اثر ارزشمند وی، کتاب «مفهوم قانون» است. رویکرد غیر ذاتگرا، به جای جستجوی مجموعهای از شرایط و ویژگیهای بایسته برای وجود قانون در کلیت مجموعه، ویژگیهای فراگیر نظامهای حقوقی واقعی را مورد تأمل و بررسی قرار میدهد. این مقاله بر روی حقوق اساسی و اداری متمرکز بوده و تعاریف استانداردهای پیشرفتهی حقوق عمومی را با فهرست سهگانه به شدت تأثیرگذار هارت از انواع «بایستهی» «قواعدِ ثانویه» عمومی که شامل قواعد شناسایی، تغییر و قضاوت است، تطبیق میدهد. مطلب این است که روششناسی غیر ذاتگرا، نه تنها یک بیان توصیفی غنی از ویژگیهای بنیادین خاص سیستمهای حقوقی پیشرفته را به دست میدهد، بلکه در مورد شیوه فهم و تصور از قانون در بسیاری از جوامع معاصر نیز بینشهای نظری قابلتوجهی را ارائه مینماید. همچنین از آنجا که تعریف بهدستآمده عمیقاً در تجارب و رویههای واقعی اجتماعی و قانونی ریشه دارد، نسبت به رویکرد هارت که مبتنی بر روایتهای فرضی درباره چگونگی امکان توسعه قانون است، نظریهای را با تفصیل بیشتر و انتزاع کمتر ارائه و مطرح مینماید.

چکیده [English]
This article seeks to understand the concept of public law from Hart's point of view by using the common method of "conceptual analysis" and with a "non-essentialist" approach and based on his valuable work, the book "The Concept of Law". The non-essentialist approach, instead of looking for a set of necessary conditions and features for the existence of law in the whole set, reflects and examines the comprehensive features of real legal systems. This article focuses on constitutional and administrative law and reconciles the definitions of advanced common law standards with Hart's highly influential triadic list of "must" types of public "secondary rules," which include rules of recognition, modification, and adjudication. The point is that the non-essentialist methodology not only provides a rich descriptive expression of the specific fundamental characteristics of advanced legal systems, but also provides significant theoretical insights into the way of understanding and imagining the law in many contemporary societies. Also, since the obtained definition is deeply rooted in real social and legal experiences and procedures, compared to Hart's approach, which is based on hypothetical narratives about how the law can be developed, it presents and proposes a theory with more detail and less abstraction.
